As Criminal Court Issues Subpoenas On Building Materials Center Management Regarding Construction Project

TEMPLE OF JUSTICE, Monrovia- The Assets Recovery and Retrieval Task Force has directed its probe at the Foundation of former Liberian First Lady, Mrs. Clar Marie Weah, with the Criminal Court “A” issuing a writ of subpoena Duces Tecum on the management of the Building Materials Center in Monrovia regarding a construction contract, as Garmah Never Lomo reports.
The Court presided by its Resident Judge Roosevelt Z. Willie on Friday November 21, 2025, issued a writ of subpoena Duces Tecum on the management of Building Materials Center by and thru its general manager and all authorized officers and shareholders.
A writ of subpoena duces tecum is a court order that compels a person to produce specific documents, records, or other tangible items relevant to a legal case, in addition to or instead of appearing to testify. The Latin phrase “duces tecum” translates to “bring with you,” highlighting the requirement to bring physical evidence to court.
The writ of subpoena Duces Tecum came as the result of petition filed by Cllr. Edwin Kla Martin, head of Asset Recovery and Property Retrieval task force praying the court.
The writ reads:
YOU ARE HEREBY COMMANDED TO SUBPEONA THE MANAGEMENT OF BUILDING MATERIAL CENTER (BMC) BY AND THRU ITS GENERAL MANAGER, CHIEF EXECUTIVE OFFICER/SHAREHOLDERS AND ALL ACTING UNDER THEIR AUTHORITIES OF MONROVIA, LIBERIA TO APPEAR BEFORE THIS HONORABLE COURT ON THURSDAY, 27TH DAY OF NOVEMBER, A.D. 2025, AT THE PRECISE HOUR OF 10:00 A.M.
The Court said, the decision TO SUBPOENA THE MANAGEMENT OF BUILDING MATERIAL CENTER (BMC) BY AND THRU ITS GENERAL MANAGER, CHIEF EXECUTIVE OFFICER/SHAREHOLDERS AND ALL ACTING UNDER THEIR AUTHORITIES OF MONROVIA, LIBERIA, TO PRODUCE COPIES OF THE FOLLOWING:
CONSTRUCTION CONTRACT EXECUTED FOR THE CONSTRUCTION OF THE CLAR HOPE FOUNDATION; PAYMENT VOUCHERS AND CHECKS FOR THE CONSTRUCTION PERIOD; PAYMENT RECEIPTS; BILL OF QUANTITY (BOQ) AND OTHER PAYMENTS DOCUMENTS RELATED TO THE CLAR HOPE FOUNDATION CONSTRUCTION AND DEVELOPMENT, WHICH ARE IN YOUR POSSESSION.
YOU ARE FURTHER COMMANDED TO MAKE YOUR OFFICIAL RETURNS TO THE OFFICE OF THE CLERK OF THIS COURT, WITH YOUR SIGNATURE ENDORSED ON THE BACK OF THE ORIGINAL, STATING YOUR MANNER AND KIND OF SERVICE AND TO INFORM THE RESPONDENT THAT UPON THEIR/IT FAILURE TO ADHERE TO THIS SUBPOENA DUCES TECUM.
The Petition further said:
AND NOW COMES, PETITIONER in the above cause of action and prays Your Honor and this Honorable Court to grant the issuance of the Writ of Subpoena Duces Tecum for the following reasons to wit:
1. Petitioner submits and says that on March 5, 2025, the Assets Recovery and Property Retrieval Task Force was re-announced thru Executive Order #145, by his Excellency Joseph N. Boakai, Sr., President of the Republic of Liberia replacing executive order # 126 and 145.
According to the petitioner, in keeping with its mandate to identify, investigate and trace all of Liberia’s stolen and suspicious assets within and out of Liberia, it has placed the construction and development of the CLAR HOPE FUNDATION, under investigation, and Hence; Petitioner prays Court for a Subpoena Duce Tecum to be served on the Respondent to produce copies of the following: (1) Construction Contract executed for the Construction of the Clar Hope Foundation, (2) Payment Vouchers and Checks for the Construction period, (3) Payment Receipts, (4) Bill of Quantity (BOQ) and other payments documents related to the Clar Hope Foundation Construction and Development, which are in the possession of the Respondent.
WHEREFORE AND IN VIEW OF THE FOREGOING, Petitioner most respectfully prays Your Honour and this Honorable Court to grant the Petitioner’s Petition in its entirety and to also grant unto Petitioner any and all other further relief that Your Honor may deem just and legal.
