LERC Rejects LIBENERGY’s Request For Reconsideration, New Tariff To Take Effect November

Monrovia, Liberia – Following its notice of August 1, 2026, informing customers, stakeholders, and the public that LIBENERGY had filed a formal application for reconsideration of the Commission’s tariff decision of July 6, 2026, the Liberia Electricity Regulatory Commission (LERC) has now concluded its review of the application, a LERC press release said here today, Tuesday, August 18, 2026.

After carefully examining LIBENERGY’s request, the supporting submissions, the tariff record, and the applicable provisions of the Electricity Law of Liberia, 2015, the Commission has rejected the request for reconsideration, finding that the company failed to present any legal, factual, or procedural basis to warrant a review of the Commission’s Tariff Decision.

LIBENERGY requested, among other things, that the Commission reinstate its proposed energy charge of US$0.25/kWh, contending that the approved tariff of US$0.22/kWh is not cost-reflective, or, alternatively, postpone the implementation of the tariff.

The Commission determined that the issues raised in the reconsideration application repeated arguments that had already been fully considered during the tariff review process and did not identify any material error of fact or law. Accordingly, the Commission rejected the application.

While rejecting the request for reconsideration, the Commission exercised its regulatory authority to defer implementation of the approved tariff from August 1, 2026, to November 1, 2026, immediately following the expiration of the four-month compliance period previously granted to LIBENERGY to address or cure identified service delivery deficiencies.

The Commission emphasized that the postponement does not modify or reverse its tariff determination, nor does it validate LIBENERGY’s assertion that the approved tariff is not cost-reflective. Rather, the extension is intended solely to provide the utility with additional time to implement corrective measures and demonstrate measurable improvements in the quality, reliability, and efficiency of its services.

The Commission assures LIBENERGY’s customers, stakeholders, local government officials that it remains committed to safeguarding public interest through transparent, fair, and evidence-based regulation. The Commission will continue to closely monitor LIBENERGY’s compliance with its regulatory obligations and service improvement commitments to ensure that customers receive safe, reliable, and efficient electricity services.
