No End In Sight In The Legal Battle Between Liberian Senate Sec. & A Foreign Businessman

TEMPLE OF JUSTICE, Monrovia, Liberia- The Liberian Senate Secretary Nanborlor Singbeh through his lawyers wants the Civil Law Court to deny and declare null and void the indemnity surety bond issued by Sky Insurance company.

The bond was filed on behalf of a foreign businessman Hens Armstrong in one million dollars for action of damages for defamation/libel by attachment.

On August 28, Armstrong has filed a US twenty million action of damages for defamation/libel against Senate Secretary Nanborlor Singbeh.

According to Armstrong, the Senate Secretary wrote a communication to the Chief Justice of Liberia and a subsequent copy to the Heritage Newspaper accusing him of committing felonious crimes against children in Norway.

The Wrights and Associates law firm representing Singbeh, dwell their argument on page 84 and 85 Section 7.15 (2) of the revised Civil procedure law which provides that an application for an order of attachment the plaintiff shall give a bond in an amount equal to one and half times the amount demanded.

Cllr.Joseph Gibson, said the attach bond by Hans Armstrong does not meet the requirements of the above quoted provision of the civil procedure law in that the plaintiff demand 20 million United States, but posted and got an approved attach bond of One million Dollars.

The movant lawyers maintain that the one million dollars approved bond from Sky insurance company is far drastically below the requirements of the statute.

“The bond should be declared null and void and therefore set aside as it does not meet the requirements as stated on pages 84 and 85 section 7.15 (2) of the revised Civil procedure law of the country,“ Cllr. Gibson said.

He went further as relying on chapter 64 section 63.2 (1) of the civil procedure law which again talk about who may sureties, but the Movant added that the surety in this proceeding the Sky insurance company does not meet the requirements of section 63.1 (a) and has fail and neglected to attach its most recent financial statements as required by law.

Instead, the insurance company attached 2020/2021 reference as “statement of changes in equity for the year ended December 31,2021.

Cllr Gibson wants the plaintiff indemnity Bond be set aside, deny and vacated, while, praying the   court to take judicial notice of the bond posted by the respondent /plaintiff in the case.

 

Accordingly, the Movant lawyers has taken exception that the company, Sky insurance tax clearance has since expired thereby disqualifying the surety from issuing insurance and or standing as a surety.

Meanwhile, the Liberian Senate Secretary General Nanborlor Singbeh lawyers wants the court grant the exceptions to the indemnity Bond posted and grant unto them all relief deem legal.
