Court Lifts Travel Ban On Former NPHIL Boss, Tolbert Nyenswah

A writ filed in 2019 imposing a travel ban on the former Director of the National Public Health Institute (NPHIL), Tolbert Nyenswah has been quashed by Criminal Court “C” in Monrovia.

Judge Yarmie Gbeisay in his ruling declared Mr. Nyenswah free man and is at liberty to return to his country any time he desires, months after he fled Liberia.

Mr. Nyensway is currently in the United States, where he fled some time ago.

Judge Gbeisay pointed out that the state filed the writ of ne exit reublica against Nyenswah “without saying what the basis of the request was.”

The Court also revealed that the writ was issued and apparently served on the Liberia Immigration Service to be circulated at various borders.

The lawyer representing the former NPHIL boss Norris Tweah had filed a six count motion challenging the legality of the writ and praying the court to nullify it.

The court further said that the fact that at the time the writ was issued, the respondent, Nyenswah, had already departed the country, renders it moot or void, and without any legal effect.

“The said writ is therefore hereby ordered set aside and dismissed and that since the perimeter of the writ not being to prevent Mr. Tolbert Nyenswah from returning to Liberia, Mr. Nyenswah is hereby declared free and at liberty to return to Liberia at any time,” the Judge’s ruling further said in his ruling.

Judge Gbeisay also said that all citizens of the country are free at all times to return to their country at will, as provided for by law.
