In his testimony on the direct, defendant Worlubah testified  on the 17th Day of March 2025, he received a called from Mary Kollie, sister to Samuel Kollie of whom he  did a C-Session on, one of my old patient. She informed me that her brother stomach was hurting for one week which was followed with vomiting and he told told her to take Samuel Kollie to the Clinic on the next day.

According to defendant Wolobah, early that morning March 18,2025, he and staffs along with the patient went through the assessment and he was diagnosed of Appendices, and he then informed his sister Mary Kollie that her brother need surgery and the amount that they concluded on was USD225.00, Two Hundred Twenty Five United States Dollars.

He further testified that, he conducted a laboratory test and he notice that the patient/ deceased was also diagnosed of hypothesis “B”, and “A” consent form was signed by sister of the deceased which led to the  conduct of the surgery. Samuel Kollie was relief of the pain. He was stable and at some point in time the nurses told him that he should use the bed pan but he said no he is able to use the bathroom, Samuel P. Kollie was stable the whole night.

Defendant Worlubah told court that after the conduct of the surgery, the next day he called Moses Kollie brother to the deceased who wasn’t there when the laboratory tests were done but he informed the deceased brother that he was again diagnosed of Hypothesis “B” and when he returned back to the ward Moses came back to he (defendant Worlubah) that his brother had died.

He stated that following the death of his patient (Samuel Kollie) he began to investigate what led to his death and the nurses told me that somebody brought food and gave it to him to eat which is against medical advice because deceased wasn’t allowed to eat within 48hrs. “We have a policy at the Clinic that whenever the patient is on the ward any relative or anyone bringing food for that patient must taste the food in front of the nurses before the patient can eat but that policy was not observed.“  However, they took the patient at the funeral home.

Defendant Worlubah said, few days later, he received a call from the Liberia Medical and Dental Council together with the Police they came his health facility (Lofa Medical Clinic) and shut it down.

“I was taken to the Liberia National Police Headquarter for one week and after their investigation at the Police Headquarter they charged me with Manslaughter and from there I was sent to the Paynesville Magisterial Court. The Paynesville Magisterial Court issued a Writ on me with the charged of Manslaughter. The next day the case was transferred to the Criminal Court “A”.

He added that, after few months, I came to Criminal Court “A” but the indictment carried Murder so that is what we are here for. According to defendant Worlubah, After the death of the deceased, he issued a death certificate that he died from heart failure.
