Milton Week’s Appeal Withdrawn From Supreme Court, In Missing L$16Bn Case

TEMPLE OF JUSTICE, Monrovia– Just days after charges were dropped against former President Sirleaf ‘sson, Charles E. Sirleaf and three other former CBL officials, lawyers representing Ex-CBL Governor Milton A. Weeks have withdrawn his Appeal to the Supreme Court.

One of his Lawyers, Cllr. Mark M.M. Marvey said they have withdrawn the appeal filed before the Supreme Court after the Justice in Chambers, Yussif Kaba ruled in a motion filed before him, which prompted them to take an appeal before the full bench.

Weeks, former Executive Governor of the Central Bank of Liberia and the others were indicted in February 2019, by the Grand Jury of Montserrado County on crimes of Economic Sabotage, Money Laundering, Criminal Solicitation.

According to Supreme Court document, when the case was called for hearing, Cllr. Mark M.M Marvey appeared for the Appellant. While, Cllr. Lafayette B. Gould Sr. appeared for the Appellee.

The Cllr. for the Appellant Mark M.M. Marvey made a submission informing the Court that the parties by and through their Counsels had filed a joint stipulation of withdrawal and abatement in which they agreed to withdraw the appeal announced to the Supreme Court. They accepted the ruling of Justice Yussif Kaba made in a Certiorari proceedings while presiding in Chambers.

Milton Weeks’ Lawyers requested the Court to issue the necessary orders leading to the formal withdrawal of this cause in keeping with the rules of the Supreme Court to said submission, the Cllr. for the state or the Republic of Liberia interposed  no objection.

The Court record continues: However, whenever the Appellant and Appellee or the petitioner and respondent shall in vacation by themselves or either Cllr. signs and files with the clerk as agreement in writing, directing the cause to be withdrawn and specifying the terms on which it to be withdrawn as to cost, shall pay to the clerk any fee that may be due him and the Ministerial officers.

It shall be the duty of the clerk to enter the case withdrawn upon the approval of the Chief Justice or any Justice of the requesting a certificate of withdrawal.

Having received the joint stipulation of withdrawal and abatement filed by the counsels for the parties and being satisfied that it is in keeping with the rules of this court, it is here withdrawn.

That the appeal announced by the Appellant in the above captioned case from the ruling of his Honor Yussif Kaba presiding in Chambers on February 19, 2019 is here by ordered withdrawn, the Court record adds.

Meanwhile, the Clerk of the Supreme Court has been ordered to strike the said Appeal from the docket of the Court and issue a certificate of withdrawal in favor of any parties requesting same and send a mandate to the Judge presiding in the court below to resume jurisdiction over the case and proceed in keeping with law.
