Rejected NEC Nominee, Cllr. Nwabudike Withdraws Court Petition

Rejected and withdrawn NEC Nominee, Cllr. A. Ndubusi Nwabudike seems to be escaping from his own shadow, as he has withdrawn his petition of Declaratory Judgement filed before the Civil Law Court at the Temple of Justice in Monrovia, after Senators said he committed perjury by allegedly lying about being a naturalized Liberian.

The controversial nominee for Chairman of the National Elections Commission (NEC), Nwabudike filed a notice of voluntary discontinue of his petition of Declaratory judgement earlier this week (on May 5, 2020).

Senators accused him of presenting fraudulent papers with conflicting information and dates.

In his notice of Voluntary Discontinuance, which states: whereas there is pending before the Honorable Civil law court of the sixth Judicial Circuit Court for Montserrado County sitting in its February term of court A.D. 2020 for declaratory judgement, filed by petitioner A. Ndubusi Nwabudike.

“Hereinafter, petitioner against the Republic of Liberia by and thru the Ministry of Justice and Attorney General, the Solicitor General and other deputies along with assistant Ministers responsible to answer all litigations against the government of Liberia, there in after respondent; and whereas the crust of the petition is a prayer to the Honorable Civil law court of the sixth Judicial Circuit Court for Montserrado County sitting in its February term of court A. D. 2020 to restate, affirm and uphold the ruling of the court of June 21,2002, by which the Civil law court admitted the petitioner as Attorney at law consistent with section 17 of the new Judiciary law to practice law before all the circuit and inferior courts of the Republic of Liberia and further to affirm and uphold the mandate of the Supreme court of Liberia admitting the petitioner in 2006 as Counselor at law of Supreme court of Liberia.”

The Court record also says that the petitioner is an employee of the respondent and respondent has not in any way or manner threatened challenge or query the standing of the petitioner as qualified counselor at law with all the rights and privileges appertaining accordingly respondent was named as party Respondent in error.

“Whereas, section 11.6(3) of 1LCLR provides that a party making a claim before a court, may voluntarily discontinue the action upon the order of court and upon such terms and conditions as court may deem proper.

“Therefore, the petitioner here in has resolved as follows that petition of the petitioner for declaratory judgement shall and same is here by withdrawn with immediate effect without prejudice.

“That the petitioner reserves the right to refill with amendment as to the parties and content and it was witnessed by  his legal Counselors who affixed their signature on this notice of voluntary discontinuance  was Atty. Mamiata Jabateh Sirleaf and approved by Judge Kennedy Peabody resident judge of Civil law court Montserrado County.”

On April 15, 2020, the rejected NEC nominee, Cllr, Nwabudike filed a petition of Declaratory Judgement over his naturalization of citizenship.

Meanwhile, the Liberian National Bar Association President Cllr. Tiawon Gongloe says even though Nwabudike has withdrawn his petition, the LNBA grievance and ethics committee is still investigating the rejected the claimed that he gave the Senate fraudulent Liberian naturalization papers.
