State Prosecutors Keeping Senate Secretary, Others’ Economic Sabotage Case Alive

TEMPLE OF JUSTICE, Monrovia- State prosecutors filed a Bill of Information against the Liberian Senate Secretary, Nanborlor F. Singbeh, former National Investment Commission Executive Director, George W. Wisner and others, who were indicted for the crimes of Economic Sabotage, theft of property, criminal conspiracy and forgery.

The indictment alleges that the defendants obtained fake and fraudulent “Investment Incentives” for duty-free privileges; even though MHM Eko Liberia was formed to engage in crushed rocks and related businesses with a capital investment of USD7,616.152; thereby creating the opportunity to defraud the Government of Liberia out of its much needed lawful revenue…”

The latest bill of information was filed by the state prosecutors, which are led by Assistant Justice Minister for Litigation, Wesseh A. Wesseh on Thursday, March 17,2022, calls for the fruits of the crimes. The equipment are said to be in the respondents/co-defendants’ possession and the prosecutors want them to be brought under the jurisdiction of the court.

Others indicted are Othello Z. B. Karr Incentive Officer National investment commission, Karel Socher, General Manager MHM EKO-Liberia, Ales Sranmek, Sherman Logan, Jan Holask, Barry F. Tequah, Eco-Bank Liberia, LTD, Afriland first Bank Liberia, Ousman Fofana, Gloria Cain, Sylvester Selvkpoh, Patrick Saah Siapiah and Mulbah Kenneh.

Senate Secretary has Singbeh has denied the allegations against him, while the former NIC executive Wisner has since described the case being pursued against him as a “witch-hunt”.

The Bill of information prayed for the court ‘to bring under the jurisdiction of this Honorable court several earth moving equipment (machines) which are subject and fruit of the crimes of these proceedings and are in possession of respondents/co-defendants, so as to prevent their continued waste and looting in consideration of the reasons showeth to writ.”

Co-defendants Nanborlor F. Singbeh and Chamarh (Sherman) Logan were indicted during the November A.D. 2021 term of court along with the other defendants for the crimes stated above and brought under the jurisdiction of this court.

The prosecutors claimed that the respondents/co-defendants are perpetrating “deceit and other criminal means, took possession of these machines/equipment that were bought and brought in by the private prosecutors, which are fruit of crimes and still unlawfully possessing these machines.”

According to the Bill of Information, the machines that are subject of these proceedings are caterpillar-950G, model/year 2007, series No. 5F01860, Hour: 14429; Caterpillar 325BLN excavator: year 1997, series No. 8FN00411 hour: 13762, UN (1) caterpillar track type tractor second hand, D6GII S/N: 1372, year: 2009; caterpillar: D6G2 XL-Dozer, series No. CAT00D6G00601372.

It also says that this equipment and assorted spare part/tools were taken away by the respondents and kept at the home of co-respondents Charman (Sherman) Logan, located on the police academy road and at the MHM EKo Liberia facility in Congo Town suburb of Monrovia.

The bill of information added:

‘That because informant father says that this court and your honor have the authority to bring under the jurisdiction of your Honor and this Honorable court these equipment, which are subject of these criminal proceedings, so as to prevent their continuous wastage and looting, pending the adjudication of these proceedings.

Wherefore and in view of the foregoing, informant prays your Honor to issue out of this Honorable court a search and seizure warrant/court’s decree to bring under the jurisdiction of this Honorable court and your honor, this equipment and assorted parts and grant until informant any and all relief equitable and just.”

At the same time, the state prosecutors are calling on the court “to deny and dismiss and reject movant’s motion for severance and separate trial.”

This, they said, is intended” to prevent legal harms to the respondent/ plaintiff and grant further an all other relief to the respondent that are legal and just.”
