TEMPLE OF JUSTICE, Monrovia- Liberian Police have arrested, investigated, charged and sent to court a 23-year-old man, Steven Nimely for allegedly Sodomizing a boy, 10 in the Doe community in the Bushrod Island suburb, in violation of Chapter 14, section 14.70 (a)(I)(b) of the New penal law,
According to police charge sheet, Defendant Nimely was acquainted with his constitutional rights and charged with rape (sodomy), after which he appeared in court on Friday.
Rape is a non-bailable crime in Liberia. And because of the rise in the number of rape cases in recent times, President George Manneh Weah sometime ago declared the rape crimd as a “national emergency”.
The police charge sheet said that on September 20,2021, defendant Nimely went to his aunty place where the survivor stayed early that September 20 Monday and told the survivor to follow him to fix phone.
While, on their way, defendant Nimely asked the survivor to have sex with him and took the survivor from his Jamaica road residence on the Doe community road in an unfinished church building. There, he asked the little boy to take off his clothes, placing oil in the survivor’s anus and began painfully forcing his penis into it.
The survivor also explained that while the defendant was painfully forcing his penis into his anus, a lady came to hang clothes in the unfinished building and saw the defendant committing the criminal act.
For his part, defendant Nimely denied having sex with the boy in the unfinished church building.
But he told police investigators that survivor chose to follow him to fix his cell phone.
Defendant Nimely explained that while going, he decided to use the toilet and went into the unfinished church building, leaving the survivor outside to watch.
Nimely added that the boy decided to follow him later into the unfinished building, saying that he too wanted to use the toilet. And he said while they were there, the woman entered and saw them.
But the woman told the Police that she saw Nimley in sexual act with the little boy on September 20,2021, during the morning hours when she went hang clothes in the unfinished church building.
The eyewitness told investigators that upon entering the building, she heard the little boy crying and the defendant was looking into the child’s anus.
But when she asked the defendant why was he looking into the boy’s anus, Nimley said something stuck in it.
Police investigation findings revealed the following:
That defendant took the survivor from his residential without the consent of the parents. The Defendant is not a relative of the survivor.
The defendant was found with a bottle of oil in his pocket at the time of his arrest.
The witnesses saw the defendant with the naked survivor in the unfinished church building.
Meanwhile, medical report obtained from the Redemption Hospital states that there was penetration as a result of blunt object, feces visible on examination, fresh substance seen on the anal opening and fresh tears seen.
